Orbit Rings Product Warranty

Petelli Ventures Pty Ltd provides this voluntary warranty against defects for genuine Orbit Rings products purchased directly from Petelli or through an authorised Petelli retailer.

Warranty Coverage

This warranty is provided in addition to any rights and remedies available under the Australian Consumer Law and other applicable laws.

Warranty periods

The following warranty periods apply from the date the product was originally delivered to the purchaser:

Fibreglass Orbit Panels — 2 years

Each genuine Orbit fibreglass-reinforced plastic panel is covered for two years against defects in materials or manufacture that cause the panel to crack, split, delaminate or otherwise suffer a structural or functional failure during normal intended use.

Orbit Pods — 12 months

Orbit Pods and their Petelli-supplied attachment components are covered for 12 months against defects in materials or manufacture that cause cracking, breakage, separation or loss of their intended function during normal planted use.

Other supplied components — 12 months

Petelli-supplied Orbit fasteners, joining hardware, brackets, attachments and accessories are covered for 12 months against defects in materials or manufacture.

The warranty period for a repaired or replaced component continues for the remainder of the original product’s warranty period. Repair or replacement does not restart or extend the original warranty period unless required by law.

What this warranty covers

This warranty covers manufacturing defects that materially affect the structural integrity, assembly or intended function of the Orbit product.
Depending on the component and the nature of the defect, covered failures may include:

  • structural cracking, splitting or delamination of an Orbit panel;
  • failure of a panel or joint attributable to defective manufacture;
  • cracking or breakage of an Orbit Pod during normal planted use;
  • failure of supplied hardware caused by a manufacturing or material defect; and
  • another functional failure that Petelli determines was caused by defective materials or manufacture.

A visible mark or variation is not automatically a defect. Petelli will assess whether the issue materially affects the product’s strength, safety or intended function.

Intended use

Orbit Rings are modular garden-growing systems intended to be:

  • assembled in accordance with Petelli’s published instructions;
  • installed on a reasonably level, stable and suitably prepared surface;
  • joined using the required fasteners at every designated connection point;
  • filled with ordinary soil, potting mix, compost and other appropriate growing media;
  • used within Petelli’s published panel configurations, installation limits and minimum bend radius; and
  • maintained as reasonably required for an outdoor garden product.

Normal exposure to sunlight, rain, irrigation, soil, compost and ordinary garden fertilisers is expected and does not, by itself, invalidate this warranty.

Orbit Rings are not structural retaining walls, water tanks, swimming pools, traffic barriers, livestock enclosures or load-bearing building products unless a particular application has been expressly approved by Petelli in writing.

Expected appearance and weathering

Fibreglass and outdoor garden products naturally develop signs of use and exposure over time.
The following are not considered defects unless they materially impair the product’s structural integrity or function:

  • minor colour, texture or finish variations between panels;
  • visible fibreglass patterning within the laminate;
  • gradual fading, dulling or surface chalking from outdoor exposure;
  • staining from soil, compost, fertiliser, irrigation water or organic material;
  • superficial scratches, scuffs or marks;
  • minor dimensional variation that does not prevent correct assembly;
  • cosmetic wear around fasteners, joints, apertures or pod locations; and
  • ordinary wear of removable or replaceable components.

Nothing in this section excludes a claim where an apparent cosmetic issue is evidence of an underlying structural or manufacturing defect.

What this voluntary warranty does not cover

To the extent permitted by law, this voluntary warranty does not cover damage or failure caused by:

Incorrect installation or assembly

  • failure to follow the current Orbit assembly or installation instructions;
  • installation on unstable, substantially uneven or inadequately prepared ground;
  • omission of required fasteners or failure to secure every designated panel joint;
  • incorrect alignment of panels or components;
  • excessive tightening, uneven tightening or use of unsuitable tools or fasteners;
  • inadequate support, anchoring or site preparation where support or anchoring is required; or
  • continued use after a joint, panel, pod or fastener has become visibly damaged or loose.

Misuse, excessive loading or external forces

  • using a panel, pod or attachment as a step, seat, handle, ladder, tie-down point or structural support;
  • compacting fill with machinery or applying loads substantially beyond ordinary garden use;
  • filling the Orbit with rocks, gravel, aggregate or other unusually dense material in a manner that exceeds the product’s intended loading;
  • impact from vehicles, tractors, mowers, excavators, tools, falling branches or other objects;
  • deliberate damage, vandalism, neglect or unreasonable use;
  • animals, livestock or pests climbing on, striking, chewing or otherwise damaging the product; or
  • moving or lifting an assembled Orbit while it remains filled.

Unapproved alteration or repair

  • cutting, grinding, drilling, heating, reshaping or modifying a product other than in accordance with Petelli’s published instructions, templates or written approval;
  • enlarging or placing pod apertures outside approved locations or dimensions;
  • repairs performed using unsuitable materials or methods;
  • use of incompatible third-party components; or
  • removal, alteration or concealment of identifying marks where this prevents reasonable product verification.

Approved pod installation, drilling or modification performed in accordance with Petelli’s current instructions does not invalidate the remainder of the product warranty.

Environmental and site conditions outside normal garden exposure

  • fire, flame, excessive heat or contact with hot equipment;
  • flood, cyclone, severe storm, hail, landslide, ground subsidence or another extreme event;
  • movement caused by unstable soil, tree roots, erosion or structural settlement;
  • prolonged contact with fuels, solvents, strong acids, strong alkalis, industrial chemicals or substances not ordinarily used in gardening;
  • pressure from an adjoining retaining structure, embankment or accumulated material outside the Orbit; or
  • use in an environment or application that Petelli has expressly identified as unsuitable.

These exclusions do not apply where the damage was caused or materially contributed to by an underlying defect otherwise covered by this warranty, or where applicable law provides a remedy.

Making a warranty claim

Stop using the affected component if continued use could cause further damage or create a safety risk.
To make a claim, contact Petelli through the Orbit warranty form or email hello@petelli.com and provide:

  1. your name and contact details;
  2. the original order number, receipt or other reasonable evidence of purchase;
  3. the approximate delivery date;
  4. a description of the affected product and component;
  5. clear photographs or video showing the issue;
  6. photographs showing the overall installation, panel joints and surrounding area where relevant;
  7. a brief explanation of when and how the issue appeared; and
  8. any product, batch or identification information reasonably requested by Petelli.

Warranty registration is recommended because it helps Petelli locate the product and purchase details, but registration is not required to exercise this voluntary warranty or any rights available under applicable consumer law.
Do not return a panel, pod or other component unless Petelli has provided return instructions or written authorisation.
Petelli may assess a claim from photographs and other information, request additional evidence, inspect the product, arrange for its return or ask the customer to retain or safely dispose of the affected component.

What Petelli will do

Petelli will assess claims within a reasonable time after receiving the information reasonably required to investigate the issue.
Where a claim is accepted under this voluntary warranty, Petelli will, at its option:

  • repair the affected component;
  • provide a replacement component;
  • provide an equivalent component where the original is no longer available; or
  • provide another appropriate remedy agreed with the customer.

A defect affecting one panel, pod or component does not automatically require replacement of the complete Orbit system. Petelli may replace only the affected component where doing so provides a complete and appropriate remedy.

Petelli’s options under this voluntary warranty do not restrict any remedy the customer is entitled to choose where the Australian Consumer Law or another applicable law gives the customer that choice.
Replacement components may contain minor design, colour, finish or manufacturing differences where the original version is no longer available, provided the replacement performs an equivalent function.

Claim and freight expenses

For an accepted warranty claim, Petelli will bear the reasonable, necessary and pre-approved costs of making the claim, including standard freight where Petelli requires the affected product to be returned.

Customers must not arrange freight, removal, disposal, repair or other chargeable work on Petelli’s behalf without prior written approval if they intend to seek reimbursement.
Where practical, Petelli may send a replacement component without requiring the original component to be returned.

If assessment establishes that the issue is not covered by this voluntary warranty, Petelli may require the customer to bear return, inspection or re-delivery costs. Petelli will disclose any proposed customer-paid cost before that cost is incurred.

International customers may be responsible for local import duties, taxes or government charges applied to replacement shipments where those charges cannot legally or practically be prepaid by Petelli, except where applicable law requires otherwise.

Purchases through another retailer

Customers who purchased an Orbit product through an authorised retailer may contact either the retailer or Petelli.
This voluntary manufacturer’s warranty does not remove or reduce any responsibility that a retailer may have under applicable consumer law.

Australian Consumer Law

The benefits provided by this voluntary warranty are in addition to other rights and remedies available to consumers under law.

Expiry of the stated Petelli warranty period does not necessarily mean that all consumer rights have expired. Consumer guarantees may continue to apply for a period that reflects the nature, price, representations and reasonably expected durability of the product.

Before publication and printing, insert here the complete prescribed Australian Consumer Law wording for warranties against defects relating to goods, reproduced exactly from the current Competition and Consumer Regulations and ACCC guidance. The prescribed wording must not be shortened, paraphrased or modified.

Limitation of this voluntary warranty

Nothing in these terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.
Subject to those non-excludable rights, Petelli is not responsible under this voluntary warranty for loss, damage or expense caused by an excluded event, incorrect installation, misuse, unauthorised modification or continued use of a visibly damaged product.

Product information, installation examples and growing suggestions supplied by Petelli are general guidance. Customers remain responsible for assessing their site, ground conditions, chosen configuration, growing medium, installation method and any local building, planning or safety requirements.
